ABN 71 071 505 685. For the purpose of these terms and conditions and the use of this website Eilish Bouchier means eilishbouchier.com for the purchase of goods and services from this website. The user of this website is ‘you’ and ‘your’ as referred to in these terms and conditions. Please read these terms and conditions carefully before proceeding to use the website as your continuing use of this website (eilishbouchier.com) deems you to be accepting and consenting to the practices described in these terms and conditions. Please read them carefully before proceeding to purchase. Please note these terms and conditions may be changed by Eilish Bouchier from time to time. Please visit this page regularly to ensure awareness of any future changes as continued use of the site following such changes shall signify your agreement to be bound by such changes.

Placing an Order, Terms of Sale and Payment

By completing a purchase order you are making an offer to purchase a product at the price set out on the website and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Payment must be made at the time of submitting the purchase order. Payment can be made by credit card only Eilish Bouchier accepts Visa and Mastercard via Stripe. You warrant that you are an authorised user of the credit card used to complete payment. Legally binding contracts may only be entered into between adults (persons aged 18 and older), so you must be of 18 years or older to place and order on this website.

All purchase orders placed through this website are subject to confirmation and acceptance by Eilish Bouchier. We will email you with confirmation of the receipt of your purchase order, and then acceptance by Eilish Bouchier will be upon your receipt of the email confirming dispatch of the product. Eilish Bouchier may reject your purchase order, and refund any payment made by you, at any time prior to your receipt of this acceptance by Eilish Bouchier.

The purchase order must be paid in full immediately upon entry into the agreement. All prices are inclusive of gst unless otherwise stated. Delivery costs are additional being clearly displayed where applicable and are included in the total cost. All transactions are settled in Australian dollars (AUD). If you are ordering from outside Australia, and your bank account or credit card is held in a different currency, you can still order by credit card — your currency will automatically be converted to Australian Dollars when you complete the transaction. The conversion rate varies from day to day with the current exchange rate. Many banks also charge a small currency conversion fee. Contact your bank or credit provider for details. In some areas of the site, prices will be shown with an estimate of the price in your home currency. These converted prices are for information purposes only, to help you get an idea of the approximate cost of a product, and they may not be the exact amounts that will appear on your credit card statement. The final charge to your card is made in Australian Dollars and the ultimate conversion rate is determined by your bank or credit provider. Therefore we are not able to take responsibility if the final amount charged to your card differs slightly from the estimated conversions we provide.

Eilish Bouchier may vary prices in the event of price changes or mistakes on reasonable prior notice to you. If Eilish Bouchier requests payment for increased prices, you may cancel the order by giving notice to Eilish Bouchier, which must be received within seven days of the announcement of the increase.

This website is protected by SSL (Secure Socket Layer) encryption. SSL is a security device which ensures that any data which you enter into a secure area of the site is encrypted during transmission over the Internet. SSL utilises data encryption to create a secure environment for you to conduct your online transactions. In order for SSL to be effective, you must be using an SSL compliant browser (e.g. Firefox or Chrome and above).

Eilish Bouchier does not store or keep credit card numbers from online transactions. The last four numbers and the expiry date of your credit card number are kept for order verification and identification purposes only. While every endeavour is made to ensure every shopping experience with us is a good one, in the event a credit card is used without the holder’s authorisation, the card holder must notify their credit card provider in accordance with their reporting rules and procedures.

Eilish Bouchier reserves the right to limit the quantities of product sold as it sees fit. It is a condition of this agreement that you do not resell the products to a third party. Eilish Bouchier does not permit the purchase of items for resale. Customers wishing to be a stockist of Eilish Bouchier products must contact Eilish Bouchier directly, where they will be informed of the options available to licence/buy higher quantities.

The website is owned and operated by Eilish Bouchier. These terms and conditions supersede all prior terms and conditions and may be revised by shãshen from time to time. Please check this page regularly to ensure you are aware of any changes in these terms and conditions.

Return of Goods

Goods purchased from this site may be returned if you are not completely happy with your purchase in accordance with the following process. This does not affect your statutory rights. Upon receipt of such goods the card used for the purchase will be credited with the cost of the goods minus the delivery charges (exceptions may apply)

You must notify Eilish Bouchier within 7 days of accepting delivery of the product and arrange return of the product within 7 days after such notification.

You must notify Eilish Bouchier by email hello@eilishbouchier.com to obtain a “return ID number”, or please call Eilish Bouchier directly.

​

You must provide a “proof of purchase”, being either an invoice, bank statement, email confirmation from shãshen, or delivery note. Product must be returned to Eilish Bouchier head office. We will advise address at time of communication.

​

On International returns you must mark on the courier company’s consignment so that the products do not attract possible customs duties and taxes again.

​

You must return the product in its original unused condition in its original packaging.

​

You are responsible for arranging any insurance for the return of the product.

​

You are responsible for the cost of the shipment for the return of the product.

​

Refunds can only be credited back to the credit card that was used to make the original purchase minus the delivery charges (exceptions may apply). The refund will be processed as soon as the items have been received by Eilish Bouchier, however, please allow 14 days from the day you return the product for your account to be credited.

Refunds will only be given to products purchased at the Eilish Bouchier online store. Refunds will not be given to shãshen stock purchased from Eilish Bouchier stockists.

No Refund or exchange can be given on earrings for hygiene reasons.

​

Exchanges are only possible if the item is available. If You wish to exchange, please make your request clear when requesting your return ID number. Exchanges will only be given to products purchased at the Eilish Bouchier online store. Exchanges will not be given to shãshen stock purchased from Eilish Bouchier stockists.

Your use of the website

You agree that you will use the website in accordance with these terms and conditions and that you will not use the website for any unlawful purpose.

You will not violate or attempt to violate the security of the website. You will not hack into the website, Eilish Bouchier computer systems or the computer systems of other users of the website. Hacking means unauthorised access, malicious damage and/or Interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.

If the product has not been dispatched to you prior to any termination of this agreement by Eilish Bouchier, Eilish Bouchier will refund to you any payment you have made prior to the termination.

These terms and conditions set out the entire agreement between you and Eilish Bouchier in respect of the sale, purchase and use of the goods. Gift Vouchers

Gift vouchers may only be redeemed at the Eilish Bouchier online store. Gift vouchers are not valid to be redeemed at any Eilish Bouchier stockist. Gift Vouchers are valid for 12 months from the date of purchase. Gift vouchers are not redeemable for cash. Unfortunately Eilish Bouchier does not take responsibility for any lost or stolen Gift vouchers.

 

Warranties

All Eilish Bouchier jewelry product come with a 6 month warranty. You acknowledge that the products require special maintenance as outlined in our ‘how to care for your jewellery’ instructions Eilish Bouchier will not be liable for any damage caused by any failure by you or to anyone to whom you give the jewellery to maintain the product properly.

Please note that the product may vary slightly from those displayed by your computer monitor. Please note that the Trade Practices Act 1974 and similar State and Territory legislation in Australia may confer rights and remedies on you which cannot be excluded, restricted or modified (“Non-excludable Rights”). Notwithstanding any other term in this agreement, Eilish Bouchier does not exclude any non-excludable rights but does exclude all other conditions and warranties, whether implied by custom, law or statute.

 

Returns by you for faulty or damaged product

Let us express our sincere apologies in advance should this occur. We check and scry each piece before it is dispatched however we acknowledge that this sometimes occurs. If you wish to return faulty or damaged product, Eilish Bouchier will gladly repair, exchange or refund the original price in accordance with the following process:

1. that the product was purchased within 6 months of faulty date.

2. you must notify Eilish Bouchier by email hello@eilishbouchier.com to obtain a “return ID number”, or please call Eilish Bouchier directly.

3. you must provide a “proof of purchase”, being either an invoice, bank statement, email confirmation from Eilish Bouchier or delivery note.

4. you must return the product to Eilish Bouchier head office.

5. on international returns you must mark on the courier company’s consignment so that the products do not attract possible customs duties and taxes again.

6. Eilish Bouchier will then refund the price to you in full, replace the product or exchange for a different product.

7. refunds can only be credited back to the credit card was used to make the original purchase. The refund will be processed as soon as the items have been received by Eilish Bouchier, however, please allow 14 days from the day you return the product for your account to be credited.

8. exchanges are only possible if the item is available. Eilish Bouchier can only exchange faulty items for the same item in the same style, subject to availability. If you wish to exchange, please make your request clear when requesting your return ID number.

9. please note that unfortunately, returns may not be made to a Eilish Bouchier stockist.

10. your acceptance of these terms and changes to the terms
